لقد حرص الإنسان منذ بدء الخليفة على الإستئثار بحيازة الأشياء سواء المنقول منها أو العقارية وعدم التفريط بملكيته لها فكانت علاقته بهذه الأشياء تعد مصيرية له ما دام يبغي بقائه على قيد الحياة بإقتنائه لأدوات الصيد من الفؤس والرماح وغيرها وعند عودته من عمله فيمكث إلى مكان راحته وإستقراره في الكهف أو ما اتخذه لسكنه فكانت مسيرته الحياتية اليومية تتجلى في الحفاظ على تلك الوسائل التي تحدد مدى قابليته على توفير حياة أفضل له ولأسرته وللجماعة وبعد تطور الحياة والمجتمعات وتكوين التجمعات البشرية من القبائل ثم الإمارات أو الدول تعززت حاجة الناس إلى توثيق ملكيتهم لهذه الاموال (المنقولة وغير المنقولة) كما عملت الدول على سن القوانين والأنظمة التي تنظم سبل التعامل ونقل الحقوق في تملك الأشياء وخاصة العقارية وتأكيد سلطانها في فرض الضرائب فجاءت النظم الإقطاعية لتظهر مدى أهمية هذه الملكية والتنافس من أجل السيطرة على الأرض وبعد أن تطورت الأنظمة السياسية وأخذها بمبادئ الحرية والمساواة وتنظيمها لطرق التملك وتصنيفها الأراضي إلى مملوكة للدولة وغير مملوكة وإعطائها للأفراد الحق في التملك بصورة تامة للأارضي وعدم إقتصارها على الملكية العامة للدولة فزاد ذلك من أهمية بصورة تامة للأراضي وعدم إقتصارها على الملكية العامة للدولة فزاد ذلك من أهمية حق الملكية بالنسبة للأفراد وكذلك للدولة والمؤسسات العامة والخاصة ذات الشخصية المعنوية.
وموضوع الكتاب الملكية الشائعة وأحكام إزالة الشيوع (دراسة مقارنة) من خلال الخطة الآتية: فقد قسمنا الكتاب إلى ستة فصول رئيسية، الأول خصص لبحث الملكية الشائعة مصدرها وصورها، أما الفصل الثاني فقد خصصناه لدراسة حق الشريك والشركاء في إستعمال وإستغلال وإدارة المال الشائع.
أما الفصل الثالث فقد درسنا فيه حق الشريك والشركاء في التصرف بالمال الشائع، أما الفصل الرابع فقد خصصناه لدراسة القسمة الرضائية وأحكامها وأصنافها وشروطها.
وفي الفصل الخامس سنستعرض فيه قيود القسمة الرضائية وآثارها وطرق أبطالها، وفي الفصل السادس المخصص للقسمة القضائية المجزء إلى مبحثين في الأول ستتطرق للقسمة القضائية ودعوى إزالة الشيوع.
