المحامي هو رجل القانون المحترف الذي يتولى الدفاع عن موكليه أو رعاية شؤونهم القانونية وهو يلتزم بالقيام بالأعمال الموكل فيها بكفاءة وإخلاص وفقاً لقواعد القانون وأصول المهنة.
فإذا خرج على مقتضى الواجب وخالف إلتزاماته القانونية تحققت مسؤوليته المهنية، بل والمدنية والجنائية أحياناً، وقد حرص قانون المحاماة على تحديد الواجبات الأساسية التي يلتزم بها المحامي، فضلاً عن إحترام آداب وتقاليد المهنة، وفي حالة مخالفته لهذه الواجبات وإرتكابه لإحدى المخالفات ترفع النقابة ضده الدعوى التأديبية التي قد تنتهي بتوقيع أحد الجزاءات التي حددها القانون عليه.
ورغم أن المحاماة كمهنة لم تكن معروفة في صدر الإسلام وقرونه الأولى، فإن فقهاء المسلمين قد اجازوا التوكيل بالخصومة على نحو معين، مع خلاف في الفرعيات، بشرط أن يلتزم المحامي حدود الحق فلا يتجاوزها، وذلك لإقتناعهم بأن كثيراً من الناس لا يحسنون الدفاع عن حقوقهم ويحتاجون حقيقة إلى من يدافع عنهم.
ولمعالجة موضوع المسؤولية المهنية للمحامين تم التحدث عنها من الناحيتين القانونية والشرعية عن تعريف المحاماة والوكالة والوكالة بالخصومة ومشروعية المحاماة وسيادة مبدأ الإستعانة بمحام في الفصل التمهيدي وخطورة مهنة المحاماة وحساسيتها بالنسبة لأصحاب المصالح أو الموكلين، ثم نبين الواجبات القانونية الملقاة على عاتق المحامي والتي تؤدي مخالفتها إلى إثارة مسؤوليته المهنية في الفصل الأول، وتستتبع توقيع الجزاء التأديبي المناسب عليه، وذلك في الفصل الثاني، ويبحث الفصل الثالث أصول المحاماة والمحامي المتمرن، أما الفصل الرابع يبين مقتضيات إستقلالية المحامي وأخلاقه، بينما الفصل الخامس يتحدث عن مشروع قانون المحاماة الجديد، أما الفصل السادس يتضمن دستور المحامين وأيضاً الملاحق تتضمن: (مشروع قانون المحاماة الجديد - مشروع قواعد السلوك المهني - مشروع المعهد الوطني للمحاماة).
