إن فقه المعاملات هو فقه المستجدات المتسارعة، تبعاً للنمو والإطراد الكبير في معاملات الناس، إما بسبب التقدم العلمي والتقني الذي قرَّب المسافات، ودمج العقول والأفكار في صياغة للعقود النافعة الموجبة لسهولة التواصل عبر القارات في لحظات، وإما بسبب ما وصل إليه الوعي الإنساني والفكر البشري من تهذيب لآليات التعاون والإستثمار، وعقود تبادل الإحتياجات، وحسن إدارة العمل والإنتاج.
وفهم الأحكام ومعرفتها والعلم بها للإنتقال إلى المعنى الإصطلاحي للفقه، يحتاج إلى معلم ومنهج وكتاب.
هذا وإن كثيراً من طلبة العلم الشرعي يَطَّلِعُون في الغالب على القسم الأول من أبواب الفقه؛ العبادات المحضة؛ من صلاة وزكاة وصيام وحج، وقليل من طلبة العلم مَن يواصل قراءة أبواب الفقه ليصل إلى العبادات الإجتماعية والعبادات المالية، بقراءة ما اصطلح على تسميته بفقه المعاملات، وقليل أيضاً مَن يثابر في تحصيله المعرفي ليتعمق في أحكام المعاملات المالية المعاصرة، وما أكثر حاجة الناس إلى ذلك.
أنهى الكاتب كل بحث ما يخصه من قرارات المجامع الفقهية؛ فيما استُجِدَّ من معاملات مالية معاصرة، ووسائل علمية تقنية، ومن المعلوم أنه عند تعذر الإجماع القولي لفقهاء الأمة في زمن من الأزمان، أو عصر من العصور، يُلجأ إلى الإجتهاد الجماعي؛ ليحقق (على أقل تقدير) إجماعاً سكوتياً، في مسألة معينة.
اعتمد المؤلف في المسائل الفقهية على كتب الفقه في المدارس الفقهية الأربعة، واكتفى بمصدر واحد من كل مدرسة فقهية للمسألة.
