فى مذهب الاتهام الفردى حيث يكون حق الاتهام للمجنى عليه توضع القيود على مباشرته للدعوى الجنائية لمعالجة عيوب اطلاق هذا المذهب, وفى مذهب الاتهام العام حيث يكون حق الاتهام للنيابة العامة توضع القيود على سلطتها فى مباشرة الدعوى للتخفيف من عيوب استئثارها بهذه السلطة.
فقيود مباشرة الدعوى الجنائية باعتبارها الوسيلة الفعالة لعلاج عيوب تطبيق مذهبى الاتهام من الاهمية بمكان. الأمر الذى جعلنا نتناولها بالدراسة حتى نعرف ما اذا كانت كافية بصورتها الراهنة لاحداث التوازن بين حقوق المجنى عليه وحقوق الدولة فى مباشرة الدعوى العمومية. ومن خلال هذه الدراسة نحاول أن نقدم توصياتنا ومقترحاتنا فى هذا الشأن.
وللوصول الى هذه الغاية سوف نبدأ بحثنا بفصل تمهيدى نوضح فيه التطور التاريخى لقيود مباشرة الدعوى الجنائية.
بعد ذلك نتناول موضوع بحثنا الرئيسى وهو قيود الدعوى الجنائية بين النظرية والتطبيق فى قسمين: تخصص الأول لبيان مضمون هذه النظرية والتفرقة بينها وببين ما قد يختلط بها من أفكار قانونية, ثم نعرض لمفهومها فى ظل مذهب الاتهام الفردى, وأخيرا تطبيق هذه القيود من الناحية العلمية فى أوضح مجالاته فى الشكوى والمطلب والإذن.
وبعد ذلك نختتم دراستنا بعرض لما نقترحه أو نوصى به للوصول بقيود مباشرة الدعوى الجنائية الى أحسن وضع لها.
