معلوم ان اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية (تريبس) هي الاتفاقية الدولية- في الوقت الحالي- التي اختصت بتنظيم كافة جوانب حقوق الملكية الفكرية بشقيها الأدبي والصناعي، ولذا؛ فقد كان مناسباً أن يكون عنوان هذه الدراسة هو: "الحماية القانونية لحقوق الملكية الفكرية في إطار اتفاقية (التريبس)" وليس في إطار منظمة التجارة العالمية إلا أنني في مرحلة الدراسة الأولية لاختيار الموضوع وجدت أن موضوع حماية حقوق الملكية الفكرية ليس مرتبطاً فقط باتفاقية (التريبس) وحدها؛ بل له ارتباط وثيق باتفاقيات ومعاهدات دولية أخرى أشارت اتفاقية (التريبس) إلى تطبيق بعضاً من أحكامها، ومن هذه الاتفاقيات ما هو ضمن اتفاقيات جات 94م (الاتفاقات التجارية متعددة الأطراف) في إطار منظمة التجارة العالمية، ولذا؛ وجدت أن الأنسب أن يكون عنوان هذه الدراسة كما هو عليه الآن: (الحماية القانونية لحقوق الملكية الفكرية في إطار منظمة التجارة العالمية) ليمكن الرجوع إلى أي اتفاق أو معاهدة في إطار المنظمة ذاتها خصوصاً عندما تحيل اتفاقية (التريبس) إلى تطبيق أحكام اتفاق من تلك الاتفاقات.
وتنقسم الدراسة إلى فصل تمهيدي وقسمين، يحتوي القسم الأول على المصنفات والأعمال الفكرية المتمتعة بالحماية القانونية، وقسم ثاني يختص بإنفاذ حقوق الملكية الفكرية.
