وما من شك فى أن أهم حرمات الإنسان هو جسده... الذى فيه يحيا بروحه، إذ الجسد مهبط الروح، وقد أسبغ الإسلام الحماية على هذا الجسد حتى بعد أن تفارقه الروح. فجعل لجثة الإنسان حرمة من الانتهاك أو الابتذال، وفى نطاق القانون الدولى العام برز هذا الحق منذ نشأة التنظيمات الدولية ومنذ بزوغ الهيئات المهتمة بحقوق الإنسان، هذا بالإضافة إلى تضمين هذا الحق فى القوانين الأساسية الداخلية، وتسابق الدول فى الوقت الراهن على مدى الالتزام بالمواثيق الدولية العالمية والإقليمية فى مجال حقوق الإنسان. إلا أنه وبالرغم من ذلك.. فان البون لازال شاسعا بين النظرية والتطبيق سواء على المستوى الداخلى أو على المستوى الدولى.
ومن هنا.. فقد وجدت أن هذا الموضوع جدير بالدراسة والتأمل فى ظل أحكام القانون الدولى لنجمع شتات هذا الموضوع ونقف به على مدى الحماية المكفولة لحق الإنسان فى السلامة الجسدية على المستوى الدولى، ووجدت أنه من الأوفق أن نتناول بالمقارنة مدى الحماية المكفولة لهذا الحق فى ظل أحكام الشريعة الإسلامية الغراء باعتبارها قانون عالمى أقر منذ بزوغه حماية متينة لهذا الحق، هذا بالإضافة إلى أن المسئولية الدولية عن انتهاك الحق فى السلامة الجسدية لازالت إلى الأن تنعقد بصورة مؤقتة وبصورة انتقائية، بعيدا عن الحيدة والتجريد، وفى ظل قانون لم يزل بنيانه بعد غير ثابت الجذور -ألا وهو القانون الدولى الجنائى، علاوة على أن أداة تطبيق هذا القانون لم تزل إلى الأن بعيدة عن الديمومة والثبات.. ألا وهى القضاء الدولى الجنائى.
ولكي تبلغ هذه الرسالة الغاية المرجوة منها. فإن بحث هذا الموضوع سوف يتم بأسلوب الدراسة المقارنة على الصعيد الدولى والشرعي والوطنى، وفى هذا الإطار -سنتناول أحكام الحماية الدولية لحق الإنسان فى السلامة الجسدية مقارنة بها فى ظل أحكام الشريعة الإسلامية الغراء... ووقوفاً على الوضع فى مصر من حيث النصوص الضامنة لحق الإنسان فى السلامة الجسدية والواقع الحاصل ومدى تطابق التطبيق الفعلى فى مصر للنصوص الدولية والشرعية والداخلية على حد سواء.
وفى ذلك أربعة أبواب، حيث نتناول فى الباب الأول مضمون الإنسان فى سلامة جسده، ثم نتعرض فى الباب الثانى لضمانات حماية حق الإنسان فى سلامته الجسدية، أما فى الباب الثالث فسوف نوضح أهم الجرائم والأفعال الماسة بحق الإنسان فى السلامة الجسدية والتى من خلالها يتم انتهاك هذا الحق. وفيما يتعلق بأحكام المسئولية عن انتهاك حق الإنسان فى السلامة الجسدية -فهذا سنتعرض له فى الباب الرابع ثم نختتم هذه الرسالة بخاتمة عامة نلخص فيها مضمون البحث ونتائجه.
