موضوع هذه الدراسة "عقد البيع الابتدائي" ودوره في نقل الملكية في العقارات، وقد اخترنا كعنوان لها "الحماية القانونية للعقود الابتدائية في البيوع العقارية، لنركز الاهتمام على نوعين من الحماية القانونية ألا وهي الحماية المدنية التي يضفيها القانون المدني على العقود بصفة عامة وعلى عقد البيع في إطار العقود المسماه" بصفة خاصة، أما الثانية فهي محاولة إضفاء حماية جنائية على العقد الابتدائي في المجال العقاري، وسنولي هذه الحماية الأخيرة اهتمامًا خاصًا محاولين تأصيل التدخل الجنائي في مجال المعاملات المدنية بوجه عام وفي مجال المعاملات العقارية على نحو خاص.
ونقسم البحث إلى قسمين كبيرين كل منهما في باب مستقل، الباب الأول ويخصص للحماية القانونية للعقود الابتدائية في البيوع العقارية ونعرض فيه للحماية المدنية والحماية الجنائية، أما الباب الثاني فسوف نخصصه للعقد الابتدائي وطرق نقل الملكية في البيوع العقارية، وسنتناول فيه دعوى صحة ونفاذ العقد الابتدائي ثم التسجيل وإجراءاته والمشاكل التي يثيرها. غير أننا سنستبق ذلك بفصل تمهيدي نتناول فيه انتقال الملكية في المنقولات وفي العقارات ونظام الشهر العقاري في مصر وهي مقدمة لا غنى عنها.
