إن مسألة المسكوت عنه شرعاً شغلتنى ردحاً من الزمن، خلال دراستى علم الحديث، وقد لازمنى هذا الشغل في مراحل الدراسة المختلفة في باكورته، ووسطه، وحتى شاء الله وكتبت أول كلمة في هذا البحث. إذ كانت تمر بي أحاديث تنقض ما درجت عليه في بداية العمر التعليمي، ومراحل الالتزام الأولى المبكرة بحمد الله تعالى، كما أنها تخالف ما تلقنته من بعض الدراسة فى أوائل العمر، إذ إننى كنت مثل كثير غيرى من أهل الصحوة الإسلامية أقول في كل أمر لم يرد، وليس مستند أقول إنه بدعة، ولو كان فيه خير لسبقنا السلف إليه، حتى إننى أنكرت بهذا الاعتقاد كثيراً من المظاهر التى كانت منتشرة في بيئتنا مثل سرادقات العزاء، وكذلك الاحتفالات بكثير من المناسبات الإسلامية كالاحتفال بليلة الإسراء والمعراج، ودخول الشهور العربية، والهجرة، وميلاد النبي (صلى الله عليه وسلم) وغير ذلك.
فلما تقدم بي العهد في دراسة علم الحديث وجدت أننى أتناقض مع نفسى في بعض المسائل التي أوافق عليها- كغيرى- ولا أنكرها، على الرغم من وجود أسباب تبديعها كختم المصحف في صلاة التراويح، وفرش المساجد، وجمع المصحف، وأشياء أخرى ستأتى إن شاء الله. فشرعت أجمع الأحاديث الواردة في مسألة المتروك، والمسكوت عنه، ثم وجدت أن مسألة المتروك ليست كالمسكوت عنه، وليست داخلة في هذا البحث فأهملت الكلام فيها إلا حينما فرقت بينهما وفقط، وقد كفانى بحثها غير واحد من أهل العلم. ومن ثم فقد اتجهت إلى توحيد الجهد في دراسة المسكوت عنه فجمعت أحاديثه، وأقوال العلماء فيه، مع دراستها دراسة متمهلة متأنية، حسبت أننى كنت فيها محايداً أبغى الإنصاف، وأقصد الحق، بعيداً عن التعصب الأعمى، أو التقليد بلا دليل ولا نظر، حتى انتهيت بعد الدراسة إلى حكم هدأت عنده نفسى، ورست على شاطئه سفينة المناقشة والمحاورة، وهو أن المسكوت عنه يفيد الإباحة لكن بضوابط وقواعد، تضبط أحكامه، وتؤسس قواعده.
