إن الشريعة الإسلامية تتمتّع بمرونة مبصرة محكمة بثوابت من الكتاب والسنّة وإجتهادات العلماء، تأمر بالمحافظة على مقاصد الشريعة، وفي العقود الأخيرة من القرن المنصرم استجدّت مسائل طبيّة لم تكن معروفة من قبل، فمنذ زمن ليس بالبعيد اكتشف العلماء بصمة الأصابع وتفرّد كلّ إنسان ببصمة تغاير الأُخرى، وكان هذا الإكتشاف العلمي في وقته من الأعاجيب والمستغربات، حتّى استقرّ العمل بها واطمأنّ إليها الناس في إثبات هويتهم.
واليوم تأتي البصمة الوراثية، وهي آية كبرى من آيات الله تعالى، وفي إثبات هوية الإنسان بعد أن زاد النسل وانفتحت البلاد والحدود وتطوّرت التقنية المعقّدة في الحاسوب والأقمار الصناعية وشاع إنتشارها، حتّى عبث بعضهم بها وأساؤوا استخدامها، فظهرت الجريمة المنظّمة والفواحش المقنّنة والمنكرات المزيّنة، وضاعت كثير من الحقائق.
ونحن في هذا العصر أحوج ما تكون إلى دراسات تتناول هذا الحديث الخطير بما يتناسب وأهمّيته.
ومن هنا، يأتي هذا البحث الواسع كمحاولة تأصيلية لمسألة البصمة الوراثية للوصول إلى رأي فقهي مناسب يعمل على تأصيل هذا المفهوم الطبّي شرعياً، ممّا يوفّر مادّة خصبة للفقه الإسلامي الطبّي تتركّز عليها بعض الممارسات الطبّية المعاصرة في ديار الإسلام، مضافاً إلى لحاظ بيان أثر البصة في إثبات النسب أو نفيه.
وهو بحث تناول البصمة الوراثية من الناحية الطبّية والقانونية والفقهية وبصورة موسّعة ودقيقة، تعتمد على المطالعات الكثيرة والذوق الفقهي السليم.
