إن الشريعة الإسلامية صالحة لكل زمان ومكان، ومصلحة لكل إنسان، تستقي أحكامها من صانع الكون وخالقه، وبارئ الإنسان وموجده، هو العليم بما يصلحه ويرفعه، وما يفسده ويضعه، فشرع له الأحكام، وخصه بالسجود والإكرام، خلقه ليكون حراً شريفاً، وعن الشرك مائلاً حنيفاً.
ولما كانت أحكام الشريعة الغراء لها مصادر ثابتة، وأحكام راسخة، كان من مبادئها، العمل على تكريم الإنسان وحماية جنابه، وتفصيل أسباب وجوده ومهامه، تفصيلاً دقيقاً، وبياناً محكماً وثيقاً، ومضى المسلم يشق دربه في هذه الحياة، حاملاً مشعل النور، يضيء لنفسه وللآخرين، ما واجهته عقبة إلا تجاوزها، ولا عويصة إلا جازها، ولا فضيلة إلا حازها؛ إلا أن ذرَّ قرنُ القرن الرابع عشر الهجري، وإذ بِشِنْشِنَةٍ تعدَّد الناطقون لها، والناعقون بها، تدعي أن من حاجة الإنسان، حرية مطْلقة، يهيم بها على ظهر هذه المعمورة، وأن الإسلام لا يعرف الحرية بل هو من أعدائها، وسارت هذه الفرية وسط الفئام والأقوام، وعمل أصحاب المصالح المادية على نشرها، وأصبحت الحرية كشعار خلقي، هو اللازمة المتكررة على أكثر الألسنة.
لذلك بحث المؤلف مسائل الحرية في الفقه الإسلامي بحثاً مستفيضاً ليهنأ به الباحث عن الحق والصواب، ويرزأ به من أظلم منه اللباب، وقد جعل بحثه مكوناً من تمهيد وثمانية فصول وخاتمة؛ أما التمهيد فهو بعنوان: "النظرة إلى الإنسان"، وفيه ثلاثة مباحث، وأما الفصول فهي على النحو التالي: الفصل الأول: الحرية مناط التكليف، وفيه أربعة مباحث، الفصل الثاني: حرية الفكر، وفيه أربعة مباحث، الفصل الثالث: الحرية والرق، وفيه أربعة مباحث، الفصل الرابع: الحرية السياسية، وفيه أربعة مباحث، الفصل الخامس: الحرية في أداء العبادة، وفيه أربعة مباحث، الفصل السادس: الحرية الأسرية، وفيه أربعة مباحث، الفصل السابع: الحريات الإجتماعية، وفيه أربعة مباحث، الفصل الثامن: الحرية الإقتصادية، وفيه أربعة مباحث، وأخيراً، الخاتمة: وفيها ذكر أهم نتائج البحث.
