Book Description
العقود الإدارية التى تبرمها جهة الإدارة أقتصرت فى بداية الأمر على ثلاثة صور وهى: عقد الالتزام أو امتياز المرافق العامة, وعقدالأشغال العامة, وعقد التوريد, وهناك عقود أخرى انبثقت من تلك العقود منها عقد المساهمة فى إنشاء مشروع ذو نفع عام وعقد القرض العام, وعقود الشراء والبيع التى تبرمها جهة الإدارة, وعقود الإيجار, وعقود العمل التى تبرمها الإدارة.
وما من شك أن عقد الالتزام أو امتياز المرافق العامة هو أهم العقود الإدارية وفيه تتخلى الدولة عن إدارة المرفق العامعلى نفقته ومسئوليته وتشغيله مدة العقد ثم يرده مرة أخرى إلى جهة الإدارة, وبمقتضى هذا العقد يحصل الملتزم على رسم من المنتفعين, ويرى الفقهاء أن عقود البوت BOT هو التطور الحديث لعقد الالتزام.
وتعاقد الدولة بنظام البوت BOT أمر له منافع اقتصادية تتمثل فى زيادة الكفاءة الإنتاجية للمؤسسات الاقتصادية, وتخفيف العبء عن الحكومة, والأخذ بآليات السوق, وتشجيع القطاع الخاص لأداء دوره فى التقدم الاقتصادى, وتخفيض الديون الخارجية عن الدول النامية, إلا أن الأمر لا يخلو من وجود مخاوف ومخاطر اقتصادية وسياسية لذا يجب أحكام الضبط على الجوء إلى وسيلة.
التعاقد بهذا النظام وذلك بالنص على شروط وضوابط تضمن إشراف ورقابة الدولة على المرفق أثناء مرحلتى التشييد والاستغلال.
ونتناول فى هذا البحث الحديث عن التعاقد بنظام البوتBOT من خلال الفصول الآتية:-
