تحتل دراسة جريمة التعذيب أهمية بالغة؛ فالواقع العملي يشهد تزايد ارتكاب هذه الجريمة بشكل ملحوظ، وعلى نطاق واسع. أنطلاقاً غي أهمية هذا الموضوع قام المؤلف بدراسته هذه معتمداً على منهج المقارنة التحليلي، وفقاً للإعلانات و المواثيق الدولية، و التشريح الوطني، و تبيان نصوص و احكام تجريم التعذيب، فبحث في تعداد الأخر و المبادئ و القواعد التي يحبه أن تحكم إجرائياً و موضوعياً سلوك و اختصاص افراد السلطة العامة (امنياً و مجتمعياً)، في ضوء احكام الصكوك و المواثيق الدولية الفرعية، و كذا احكام الدستور و التشريع الوطني المصري، وصولاً إلى تبيان الكيفية التي يمكن من خلالها تقليص و حسر افعال و ممارسات التعذيب وطنياً. هذا وقد جاءت خطة البحث فقسمه حسب الفصول التالية:
فصل تمهيدي: نتناول في خلال استبيان الجذور التاريخية و التعريفية للتعذيب و مناهضته.
الفصل الاول: الاساس القانوني للحق في عدم التعرض للتعذيب.
الفصل الثاني: اركان جرائم التعذيب الدولية و المسئولية الجنائية الناشئة عنها.
الفصل الثالث: اركان جريمة التعذيب الوطنية و المسئولية الجنائية الناشئة عنها. ومن ثم تتوالى الفصول لتقدم دراسة شاملة و كافية حول الحماية الجنائية للإنسان في التعذيب في ضوء المواثيق الدولية و التشريعات الوطنية.
