أقر المشروع العراقي في القوانين الإجرائية العديد من الحقوق والواجبات الإجرائية التي تهدف في مجملها إلى تحقيق العدالة وحماية حقوق الأفراد الموضوعية الرامية إلى سرعة الفعل في الدعاوى، بوصول الحقوق إلى أصحابها في أقرب وقت. وبأقل النفقات، وهو ما يقتضي إلزام الخصوم باستخدام تلك الحقوق والواجبات على وفق الغرض التي شرعت من أجله.
وعلى خلاف هذا الأصل الذي شرعت من أجله الحقوق والواجبات الإجرائية، فقد كان للمتغيرات الاقتصادية والاجتماعية التي شهدها العصر الحاضر أثر كبير في ازدياد عدد المنازعات وتعقدها وكثرة اللجوء إلى القضاء، مما أدى إلى تكدس الدعاوى واكتظاظ المحاكم بالخصومات، وترتب على ذلك بطئ التقاضي حتى أصبحت ظاهرة تهدد العدالة.
وحاول المؤلف من خلال هذه الدراسة وضع تعريف محدد لجزاء الأبطال لتوضيح خصائصه وبيان المحل الذي يرد عليه وتحدد أساسه القانون، ورد حالات الأبطال التي نظمها مالمشروع العراقي بنصوص عديدة ومتناثرة في قانون المرافعات إلى قواعد عامة وأصول.
