تنظر القوانين الوضعية إلى مسألة الزنا على أنها مسألة شخصية لاتمس مصلحة الجماعة فمادامت قد تمت عن تراض فلا يهتم بها ولا يعتبرها جريمة، إلا إذا كان أحد طرفي الجريمة زوجاً ففي هذه الحالة يعاقب على الفعل لحق الزوج الآخر أما الشريعة الإسلامية فإنها تعتبر الزنا من الجرائم المضرة بمصلحة الجماعة وتعتبرها اعتداء على كيان الأسرة التي هي أساس الجماعة، ولهذا اعتبرت عقوبة الزنا من حقوق الله سبحانة وتعالى وينبني على هذا الاختلاف في النظرة أن طبيعة القانون سهلت انتشار الفاحشة، بينما التشريع الإسلامي إذا حكم فإن روحه المهيمنة تمنع ذلك بل ويكاد في ظلمه ينعدم.
بعد هذا تبدو أهمية وجود بحث محرر لأحكام الزنا في الشريعة وهذا ما حاولت القيام به مستعينا بالله وقد قسمته إلى مقدمة وثلاثة فصول وخاتمة الفصل الأول: في التعريف، حيث سنتعرف على التعاريف المختلفة للزنا عند فقهائنا الأجلاء، ونخلص من ذلك إلى أركان الجريمة التي لا تثبت إلا (بوجودها) حيث نناقشها مبينين ما هو منها وما ليس منها، الفصل الثاني: في أصناف الزناة وعقوباتهم، وسنتحدث عن كل من البكر، الثيب، الرقيق، وعقوبة كل منهم، الفصل الثالث: في الأدلة التي يثبت بها الزنا، وسنتحدث عن ما هو محل اتفاق وهو الإقرار والشهادة مبينين شروط كل. ثم عن المختلف فيه من الأدلة، الخاتمة: حيث نسجل نتائج البحث.
