إنّ ما يقوم به الباحث اليوم من الإستقراء لآراء المفكرين والعقلاء المنطقيين والشرعيين، فيما يخصُّ إدراك ماهية العقل وحقيقته، وطبيعة موضوعه ومن ثم الإنتقال إلى دور هذا العقل في مجال من المجالات، وخاصة منها موقفه من التشريع الإسلامي الحنيف.
فإنّ الباحث ليقف أمام أربع إتجاهات إثر ذلك؛ وهي: 1-إمّا إهمال دور العقل كلياً في بناء الحكم، والنزوع إلى النصِّ الشرعي في إيجاد ذلك فقط، 2-أو إعتماد العقل المصدر الوحيد في إصدار الحكم، دون أخذ النصِّ الشرعي في الإعتبار، 3-أو إعتبار العقل مصدراً مشرِّعاً للحكم، يرجع إليه كما هو الحال في الرجوع إلى القرآن الكريم والسنّة، 4-وإمّا تبني العقل كمرجعية في إثبات المصدر الشرعي المصدر للأحكام من جهة، ومن جهة أخرى الإعتماد عليه في الإستنباط من النصّ الشرعي كآلية توضيحية مبينه له.
وعليه، فإنّ هذه الإشكالية كانت الدافع المحرِّض في البحث عن الحق والصواب في ذلك، وبيان آراء العلماء من أهل الأصول والمنطق، ومن ثمَّ التطلع إلى معرفة حقيقة العقل ودوره بالنسبة للتشريع الإسلامي بما يوافق ومنطلقات الدين الإسلامي الحنيف.
