لا مشاحّة في أن أحكام القضاء تعتبر مصدراً إحتياطياً وإستدلالياً يمكن اللجوء إليها بغرض الكشف عن قواعد القانون الدولي وإثبات وجودها وتفسيرها وتحديد مضمونها، ذلك أن القانون الدولي لا يعترف بنظام السوابق التي تقيّد القاضي، بل يمكن الإستدلال بأحكام القضاء عند تحديد مضمون القاعدة القانونية.
... ويبقى الغرض من إنجاز هذا الجامع، محاولةً لسدٍّ الفراغ الرهيب الذي تعرفه المكتبةُ العربية في حقل الإجتهاد القضائي الدولي، وللتعريف به وترويجه بل والسعي إلى تعميمه.
ونظراً لتعذّر إستعراض الإجتهاد القضائي الدولي لمختلف المحاكم والهيئات القضائية الدولية في مختلف مجالات القانون الدولي، آثرنا الإقتصار على مجال المعاهدات الدولية، التي وإن كانت تعتبر مصدراً مباشراً للحقوق والإلتزامات بين أطرافها، فإنها في الوقت ذاته تعتبر مصدراً لنشوء قواعد القانون الدولي.
