يتناول الكتاب تعريف الخلافة أي الحكومة الإسلامية بمعنى أن الاختصاصات لهذه الحكومة تقوم على التكامل بين الشئون الدنيوية والدينية وكيف يتم اختيار الخليفة، فهذا الاختيار عن طريق الانتخاب بواسطة الأمة الإسلامية بشروط تحقيق العدالة والعلم والحكمة، بمعنى ألا يكون المرء فاسقًا في أعماله وذلك يكون بشهادة الشهود من المجتمع، كما أن يكون الناخب على درجة من العلم ملمًا بالشريعة الإسلامية بصفة عامة وعن الحكمة أن يكون على قدر من الكفاءة التي تكتسب من خلال الخبرة والممارسة بالحياة العامة وشئون الحكم كما يجب أن يكون الناخب متصلًا بالشعب وعلى علم بما يحدث حوله.
ومن هنا من يتولى الحكومة أو الخلافة يصبح رئيس السلطة التنفيذية والقضائية في النظام الإسلامي وأن نطاق الولاية يمتد إلى المسلمين وكذلك لغير المسلمين المقيمين في هذا البلد مع مراعاة أن حدود ممارسة الولاية يقتصر على مبدأين هما عدم انتهاك القانون أو ما يسمى في القانون الجديد بتجاوز السلطة وأنها في حدود القانون عليها أن تمارس سلطاتها في صالح الأمة. وأن عند وفاة الوالي ينتهي هذا العقد لأنه عقد شخصي محض لا يمتد إلى الوراثة.
ومن هذا العرض المبسط استطاع السنهوري أن يثبت لجيله والأجيال اللاحقة أن فقه الخلافة منبع خصب تستطيع شعوبنا منه الأسس الإسلامية لإقامة الحكم الصالح على مستوى الأمة الإسلامية الموحدة.
