إن الحكم القضائي المرتب للحقوق والمراكز والأثار القانونية هو الحكم بمعناه الضيق أو الخاص وهو ذلك الحكم النهائي الذي يصدر في خصومة معينة فيؤدي إلى إنهائها، وإن لهذا الحكم عناصره المتمثلة بعنصره الموضوعي الذي بموجبه يميزه من غيره من الأعمال والقرارات التشريعية والإدارية من خلال إتصافه بصدوره في منازعة بين خصمين أو أكثر ويطبق إرادة القانون العامة على حالة معروضة فعلاً أمام القضاء، كذلك له عنصره الشكلي الذي يتمثل بالمظهر الخارجي له من خلال وجوب صدوره من محكمة قضائية مختصة، إذ لا يعتبر حكماً القرار الصادر من هيئة حتى ولو كان أحد أعضائها قاضياً، كذلك يتجسد المظهر الخارجي للحكم من خلال نص المشرع على وجوب صدوره وفقاً لإجراءات شكلية صحيحة، وأن يتضمن بيانات قانونية معينة تميزه من غيره من القرارات، ولهذا الحكم طبيعة قانونية تميزه من غيره من الإجراءات القضائية الأخرى فهو عمل قانوني مادي، وليس تصرفاً قانونياً وإجرائياً، لأن القاضي عندما يقوم بإصدار الحكم وبالرغم من أنه يعمل طبقاً لإرادته المتوافقة مع حكم القانون فإنه لا يعمل إرادته تلقائياً بل طبقاً لوظيفته لذا لا يعتبر عمله تصرفاً قانونياً بل عمل قانوني مادي.
