لقد أخذ المشرع بنظام التقاضي على درجتين، من هنا كانت محكمة الدرجة الأولى وخصها المشرع بدعاوى معينة سواء من حيث القيمة أو خروجاً على القاعدة بأن خصها ببعض الدعاوى مهما كانت قيمتها كدعوى القسمة فهي تنظر أمام المحاكم الجزئية أياً كانت قيمتها، ومحكمة الدرجة الأولى قد تكون جزئية وقد ابتدائية، ومحكمة الدرجة الثانية قد تكون هي المحكمة الأبتدائية منعقدة بهيئة استئنافية، وقد تكون محكمة الإستئناف العالى هذا من الناحية المدنية.
أما الدعاوى الجنائية فهناك محكمة الجنح والمخالفات وهي محكمة الدرجة الأولى، وهناك محكمة الجنح المستأنفة وهي محكمة الدرجة الثانية -يضاف إلى ذلك محكمة الجنايات.
ونظراً لأهمية هذه المواضيع فقد أعددنا هذا المؤلف الشامل من خمسة كتب. الكتاب الأول -ونفرده للدعوى المدنية أمام محكمة أول درجة ونعرض فيه إلى إجراءات رفع دعوى، وطريقة وميعاد رفعها، شروط قبول الدعوى، وتقديرها، والطلبات فيها ونظرها أمام المحكمة وما يتعرض سيرها والحكم فيها.
والكتاب الثاني -ونفرده للدعوى المدنية أمام محكمة الإستئناف ونعرض فيه إلى أحكام عامة وشروط قبول الطعن، الصفة في الطعن، من هو الطاعن، ومن هو المطعون عليه. ثم نعرض إلى مراحل الأستئناف وميعاده وشروط قبول الإستئناف، وأنواعه والحكم فيه.
أما الكتاب الثالث -فنفرده للدعوى الجنائية أمام محكمة أول درجة وهي محكمة الجنح والمخالفات ونظر الدعوى أمامها والإجراءات التي تتبع بشأنها.
والكتاب الرابع -نتحدث فيه عن محكمة الدرجة الثانية وهي محكمة الجنح المستأنفة، تشكيلها وأختصاصها والإجراءات التي تتبع أمامها ونتحدث عن المعارضة الإستئنافية، والدعوى المدنية التى ترفع بطريقة التبع وأرتباطها بالدعوى الجنائية.
وأما الكتاب الخامس، فنعرض فيه لمحكمة الجنايات والإجراءات التي تتبع أمامها وإعادة الإجراءات والدفاع والمرافعة أمامها، وعلى هذا جرى البحث في هذا المؤلف، الله أدعو أن أحقق به من النفع كل ما أريد. وعلى الله وبالله وحده التوفيق وهو خير معين.
