السقوط هو جزاء إجرائي لعدم القيام بواجبات إجرائية معينة، أو لعدم استعمال حقوق معينة من هذا القبيل خلال ميعاد محدد أو قبل حدوث أمر معين.
واستنادًا إلى ما تقدم سنعرض في هذا المؤلف: الدفع بسقوط حتى المجني عليه في الشكوى في فصل أول، والدفع بسقوط الحق في إقامة الدعوى الجنائية في فصل ثاني، والدفع بسقوط الحق في تنفيذ أوامر الضبط والإحضار والحبس الاحتياطي في فصل ثالث، والدفع بسقوط الحق في إلغاء الأمر بألا وجه لإقامة الدعوى الجنائية أو العودة للتحقيق لظهور دلائل جديدة في فصل رابع، والدفع بسقوط الحق في المطالبة بتعويض الضرر الناشئ عن الجريمة في فصل خامس، والدفع بسقوط حق المدعي بالحقوق المدنية في الالتجاء إلى القضاء الجنائي في فصل سادس، والدفع باعتبار المدعى بالحقوق المدنية تاركًا لدعواه في فصل سابع، والدفع بسقوط الحق في الاعتراض على الأمر الجنائي واعتباره كأن لم يكن في فصل ثامن.
والدفع بسقوط الحكم الغيابي بالعقوبة الصادر من محكمة الجنايات في جناية في فصل تاسع، والدفع بسقوط الحق في الطعن بالمعارضة في فصل عاشر، والدفع باعتبار المعارضة كأن لم تكن في فصل حادي عشر، والدفع بسقوط الحق في الطعن بالاستئناف في فصل ثاني عشر، والدفع بسقوط الطعن بالاستئناق المرفوع من النيابة العامة عن الحكم الغيابي في فصل ثالث عشر.
والدفع بسقوط الطعن بالمعارضة لصدور حكم بات في موضوع الدعوى بناء على استئناف النيابة العامة للحكم الغيابي في فصل رابع عشر، والدفع بسقوط الطعن بالاستئناف المرفوع من المتهم في فصل خامس عشر، والدفع بسقوط الحق في الطعن بالنقض في فصل سادس عشر، والدفع بسقوط الطعن بالنقض في الحكم الغيابي الصادر من محكمة الجنايات في جناية في فصل سابع عشر، والدفع بسقوط الطعن بالنقض المرفوع من المتهم في فصل ثامن عشر، والدفع بتنازل المدعي عن دعواه وبتنازل الطاعن عن طعنه في فصل تاسع عشر.
والدفع بسقوط الحق في تنفيذ العقوبة في فصل عشرين، والدفع باعتبار الحكم بالعقوبة الموقف تنفيذها كأن لم يكن في فصل حادي وعشرين، والدفع بسقوط الحق في إبداء الطلبات والدفوع في فصل ثاني وعشرين.
