إن الثورة التكنولوجية المعاصرة أسهمت في تطوير المتاجرات والمبادلات الدولية وتسهيلها وإبتكار صورٍ جديدة من المبادلات، وإن التداول الإلكتروني للعملات هو أشهر صور المتاجرة المعاصرة، إلا أنه متاجرةٌ بالنقود والعملات لا بالسلع والخدمات.
وهو من منتجات الهندسة المالية الرأسمالية؛ لذا وجب النظر فيه وفي عقوده وأنظمته، إلا أن البحثَ سلَّط الضوء على الجانب العملي لهذه العقود، وذلك بتصويرها وفْقَ واقعها، ثم تقويمها من الناحية الشرعية الفقهية، ثم إقتراح البدائل الشرعية للعقود المحرمة، والنظر في مدى شرعية هذه البدائل أيضاً.
يؤصل الفصل الأول لشروط عقد الصرف والصرف في الذمة والتقابض الشرعي تأصيلاً فقهياً شرعياً، ثم يذكر بإختصار أنواعَ الربا التي تترتب على الإخلال بالضوابط الشرعية للصرف.
ثم يلقى الفصلُ الثاني الضوءَ على عقود التحوُّطِ وصُوَرِها وأحكامها الشرعية، ويأتي الفصل الثالث بتفصيل القول في البيع بالهامش والذي كَثُر السؤالُ عنه، مع قلةِ الأبحاث فيه، فحاول البحثُ أن يُنيرَ الجوانبَ الغامضةَ والمعتمةَ من هذا النظام للتداول الإلكتروني، بتوضيح صورته ومزاياه وأضراره، ثم شَرْحِ آلية التداول الإلكتروني فيه، وذِكْرِ طرفٍ من الأخبار الإقتصادية والسياسية المؤثرة على مؤشرات التداول، ومدى صحة العلاقة بينهما.
ثم يُخْتَم الفصلُ الثالثُ بتفصيل الحكم الشرعي المتعلق بالبيع بالهامش وَفْقَ التوصيف المذكور في البحث، مروراً بحساب الفوركس الإسلامي وتقويمه شرعياً، وبيان الآثار الكلية للمضاربات في النقود والعملات على إقتصادياتنا المحلية والإقتصاديات العالمية.
