Book Description
الصناديق الخاصة هي كل نظام في أي جمعية أو نقابة أو هيئة أو من أفراد تربطهم مهنة واحدة أو عمل واحد أو أي صلة اجتماعية أخرى تتألف بغير رأسمال ويكون الغرض منها وفقا لنظامه الأساسي أن تؤدى إلى أعضائه أو المستفيدين منه تعويضات أو مزايا مالية أو مرتبات دورية أو معاشات محددة.
وترجع بداية العهد بالصناديق الخاصة إلى القانون رقم 53 لسنة 1973 الذي سمح بإنشاء صناديق تخصص فيها موارد معينة للإنفاق على الخدمات العامة الحيوية والعاجلة التي لم يحدد لها بنود في الموازنة العامة للدولة سلفًا، وتمويل بعض المشروعات والخدمات بالمحليات في إطار الخطة العامة للدولة، على أن تؤول فوائض هذه الصناديق إلى الموازنة العامة في نهاية السنة المالية.
هذه الأموال قدرها الجهاز المركزى للمحاسبات فى السنة المالية 2010 - 2011 بمبلغ ترليون و272 مليار جنيه تشمل صكوك وسندات وأذون على الخزانة وحسابات خاصة أخري بلغت حسب تقديرات الجهاز المركزي للمحاسبات حوالي 6316 حسابا.
ومن المثير أن هناك جهات لها امتيازات خاصة أو أن الحكومة تفتح الباب للمحسوبيات أو الفساد وأولها أن الحكومة لديها ميزانية تحدد من خلالها نسبة لكل جهة محكومة بإيراداتها العامة بصرف النظر عن احتياجاتها، ولذلك تبلورت الفكرة وبدأت في المحليات والمحافظات التي تحدث بها مشاكل تعجز الموازنة عن تمويلها، وقررت المحافظات والمحليات تكوين صناديق خاصة بها يتم تمويلها من رسوم الجراجات والمحاجر وسارت على نهجها الجهات الأخرى.
وأراد المسئولون منحها غطاءً شرعيًا فصدر قرار بإنشائها بهدف منحها المرونة في الصرف بعيدا عن البيروقراطية واستقلالها إدارياً ورغم أن الهدف من إنشائها نبيل، إلا أن هذه الصناديق أحيطت بها شبهة فساد منذ إنشائها بسبب وضعها في حساب خاص بالبنوك التجارية بعيدًا عن رقابة البنك المركزي وعدم إدراجها في الموازنة العامة وفقا لقرار إنشائها، ويقتصر الأمر على خضوعها للجهاز المركزي للمحاسبات ولذلك تضاربت الأقاويل حول حقيقة أرقامها وأوجه الصرف، بالإضافة إلى نظام المحسوبيات والمكافآت التي يحصل عليها المستشارون خاصة في المراكز البحثية ولذلك حدث إهدار كبير للأموال الموجودة بها.
لقد أصبحت هذه الصناديق مغارة على بابا للفساد وهذه هى أول دراسة جادة تنشر فى هذا الموضوع.
