رأيت من واجبي وإتمامًا للفائدة وتحقيقا للرغبة النبيلة عمل كتاب عن تاريخ القضاء في الحرمين الشريفين ليكون لبنة جديدة ومهمة في البناء الحضاري لتاريخ الحرمين الشريفين لا سيما ومعظم المادة العلمية المتعلقة بهذا الموضوع توجد في أرشيف دار الوثائق القومية بالقاهرة، كذلك فإن هذا الموضوع سوف يكشف جوانب حضارية لصالح النظام القضائى في الإسلام في مواجهة النظم الغربية الحديثة، ومن ثم فقد جعلته تحت عنوان: "تاريخ القضاء في الحرمين الشريفين إبان القرن الثالث عشر الهجري/ التاسع عشر الميلادي". وأما خطتي في معالجة قضايا هذا البحث فقد قسمته إلى مقدمة وتمهيد وخمسة فصول وخاتمة.
