الإشكالية الرئيسية التي نتعرض لها بالبحث يدور محورها حول الإجابة عن السؤال التالي: هل قواعد المسئولية في كل من القانون المدني والتجاري كافية لتحقيق حماية فاعلة للمستهلك في ظل الانفتاح الإقتصادي، والتحول إلى إقتصاد السوق، وما ترتب عليه من آثار؟ ، وقد إعتمد في تلك الدراسة على المنهج المقارن، ففي الباب الأول اعتمد على منهج المقارنة الأفقية، وهذا المنهج يعتمد على بحث المسألة في كل قانون من القوانين محل المقارنة على حدة، بحيث لا يتعرض الباحث لموقف القانون الآخر، حتى ينتهي من بحث المسألة في القانون الأول.
وفي الباب الثاني اعتمدت علة منهج المقارنة الرأسية، وهذا المنهج يتناول كل جزئية من جزئيات البحث في كل القوانين محل المقارنة في آن واحد، وهذا المنهج يتناسب مع القوانين ذات الصياغة المتقاربة أو الطبيعة الواحدة، ولذلك فقد اعتمدت على هذا المنهج عند تناولي للقوانين الحديثة الصادرة في مصر، والاتحاد الأوروبي، وجمهورية الصين الشعبية... وبجانب اعتمادي على المنهج المقارن، استخدمت أيضاً المنهج التحليلي، وترتيباً على ما تقدم رأيت أن اقسم تلك الدراسة إلى باب تمهيدي "حماية المستهلك والتطور القانوني لمسئولية المنتج" ، وبابين هما الباب الأول "حماية المستهلك من المنتجات المعيبة في القواعد التقليدية في القانون المقارن" ، الباب الثاني "حماية المستهلك من المنتجات المعيبة في القواعد الحديثة في القانون المقارن"
