يعد موضوع العلاقة بين المالك والمستأجر في ظل تطبيق قوانين إيجار الأماكن من أكثر المسائل تعقيداً في الوقت الحالي، فأزمة الاسكان التي يقال أنها المبرر الرئيسي لوجود هذه القوانين قد تفاقمت إلي حد كبير وأصبح أهم أسباب تفاقمها هو هذه القوانين ذاتها، ويزيد المسألة تعقيداً- في نظري- عدة عوامل:- عامل أساسي يتمثل في ارتباط هذه القوانين إلي حد بعيد في أذهان المصريين بما يسمي "مكاسب الطبقات الكادحة في مرحلة التحول الاشتراكي" وان كان هذا العامل قد أهتز بعنف في ظل التحول المفاجئ نحو المذهب الفردي وسياسات التخصيص والتحرر الاقتصادي، الثاني هو إجماع الأراء- تقريباً- علي أن بقاء الحال علي ما هو عليه في هذا الشأن أمر يتعارض مع أبسط قواعد العدالة خاصة فيما يتعلق بحقوق مالك العين المؤجرة، ورغم ذلك فإن تعديل هذه القوانين بطائفة لا يستهان بها من المواطنين يجعل المشرع متردداً في اتخاذ خطوة جوهرية في هذا الشأن، والثالث ان المشرع قد خطا خطوة جوهرية وهامة حين أقدم علي تعديل القواعد القانونية التي يخضع لها إيجار الأراضي الزراعية والتي يتضمنها المرسوم 178 لسنة 1952 بشأن الإصلاح الزراعي وتعديلاته، وذلك بالقانون رقم 96 لسنة 1992.
ثم خطت المحكمة الدستورية العليا خطوة واسعة بالحكم بعدم دستورية ما تضمنته مادة 29 من القانون رقم 49 لسنة 1977 في شأن تأجير وبيع الأماكن وتنظيم العلاقة بين المؤجر والمستأجر من استمرار عقد إيجار المسكن- عند ترك المستأجر الأصلي له- لصالح أقاربه بالمصاهرة حتي الدرجة الثالثة- الذين أقاموا معه في العين المؤجرة مدة سنة علي الأقل سابقة علي تركه العين أو مدة شغله لها أيهما أقل.
ونظراً لأهمية هذا الحكم الأخير وما تضمنه من مبادئ لا تتعلق فقط بقوانين إيجار الأماكن بل أيضاً- وبصفة جوهرية- بقواعد الملكية وبسلطة المشرع في تنظيم الحقوق في القانون المدني وفي الشريعة الإسلامية، فقد رأينا أن نتناول بالشرح والتعليق المسائل التي آثارها وماله وما عليه.
