القانون الدولي العام يجسد النظام العام الرضائي الذي يحكم العلاقات الدولية، وهذه الطبيعة الرضائية في قواعد القانون الدولي العام لأزمته منذ نشأته على يد الفقيه الهولندي "جروسيوس" الملقب "بأبي القانون الدولي" ومروراً بتطوراته المتلاحقة التي لعب فيها الفيلسوف الإنجليزي "بنتام" دوراً مهماً، ثم شهدت كثيراً من التداعيات التي أكدت على مر التاريخ هذه الطبيعة الرضائية، من خلال المصدر الرئيسي للقانون الدولي العام وهو المعاهدات والاتفاقيات الدولية؛ إذ كان الفضل الأكبر في هذا لمعاهدات وستفاليا عام 1648م التي وضعت اللبنة الأولى في بناء صرح القانون الدولي العام، متضمنة العديد من الأسس التي حكمت العلاقات بين الدول ما يقرب من قرن ونصف قرن من الزمان. ثم سطع مصطلح التحكيم الدولي في سماء القانون الدولي العام ليؤكد ويجسد هذه الطبيعة الرضائية، ذلك أنه ينهض، في معناه ومبناه، على مبدأ سلطان الإرادة، وأصبح التحكيم الدولي نظاماً قضائياً عالمياً، كإحدى شطري الوسائل القضائية، مع محكمة العدل الدولية، لتسوية المنازعات الدولية بالطرق السلمية.
وحول التحكيم التجاري الدولي تأتي الدراسة في هذا الكتاب ومهمة الباحث فيها الوقوف على الأحكام القانونية للتحكيم الدولي، كنظام قانوني مناسب لفض المنازعات التي يمكن أن تثور بشأن المشروعات الدولية المشتركة، وكذلك للتنظيم القضائي المصري، صاحب الاختصاص الأصيل والولاية العامة، في الفصل في المنازعات، وكذلك لقيامه بدور مكمل للتحكيم الدولي، لا سيما وقد استحدث المشروع المصري قانوناً خاصاً بالتحكيم في مجال القانون التجاري الدولي، أحد روافد القانون الدولي العام المعاصر، وذلك بغية رصد تلك الأحكام للوصول إلى تقييم يعتمد على الرؤية العلمية لها. والتنقيب عن آليات عملية، من خلالها، تساهم في تفعيل دور التحكيم الدولي والقضاء لتسوية منازعات المشروعات الدولية المشتركة.
وتجدر الإشارة إلى أن هذه الدراسة جاءت في إطار رسالة جامعية لنيل درجة الدكتوراه، وقد تم منح الباحث درجة الدكتوراه في القانون بتقدير "جيد جداً مع مرتبة الشرف" وهو أعلى تقدير تمنحه كليات الحقوق في مصر.
يتناول الكتاب عرض تحليلي لدور التحكيم التجاري الدولي وفض المنازعات التجارية الدولية ويعد مرجعاً قانونياً هاماً في مجال فض المنازعات التجارية الدولية .
