لا شك، إن الأمة الكردية أمة عظيمة وشعب كُردستان شعب عريق، لهم أرضهم ولغتهم وتراثهم وثقافتهم كما لسائر الأمم والشعوب على وجه المعمورة، ولكن الأمة الكردية بقيت محرومة من الحقوق الشرعية والقانونية لأسباب عديدة ومنها السياسية والتاريخية. من هنا أراد مؤلف هذا الكتاب الدكتور حسن خالد مصطفى محمود المفتي إبن المدينة الشهيدة (هَلَبْجة) ، والذي لاقى مع غيره من ابناء مدينته الكثير من المآسي أراد أن يبحث في "حقوق الأمة الكردية في نظر الشريعة الإسلامية" فخصص هذا الكتاب بجميع مقالاته/ محاوره التحليلية للبحث في القضية الكردية من منظور اللشريعة الإسلامية ولائحة حقوق الإنسان الدولية، ولا سيما حق كُردستان الشرعي والقانوني في إعلان الدولة المستقلة على أراضيها التاريخية، فتناول تاريخ الكُرد السياسية وجغرافية أراضي كُردستان المباركة بنص القرآن الكريم، وسلّط الضوء على أهم الدول والإمارات والمملكات الكُردية المستقلة أو شبه المستقلة، ولا سيما بعد الفتح الإسلامي، وناقش أهم الإعتراضات الواردة على استقلال كُردستان ودفعها بالأدلة النقلية والعقلية، في سعي لإثبات حضارة الكُرد وجدارتهم على الحكم وبناء الدولة قديماً وحديثاً، وأهليتهم لذلك ولا سيما في إقليم كردستان العراق الفدرالي، وتكاملهم السياسي لإعلان دولتهم الكردية المستقلة، وقد استند المؤلف في طرحه تلك القضايا إلى الأدلة الشرعية من الكتاب والسّنة، وإلى المعروف والمعقول من البراهين، وكذلك إلى الأدلة التاريخية من المصادر المعتمد عليها عند البلدانيين والمؤرخين الإسلاميين وغيرهم.
