مما لا شك فيه أن حرية وحياة الإنسان محل نظر وتقدير المشرع ولذلك أفرد لها المشرع باباً من قانون العقوبات جرم فيه خطف الأطفال والإناث وكذلك جرم القبض على الأشخاص بدون وجه حق أو مسوغ شرعى وسأحاول أن أعرض لهذه الجرائم، وذلك في عشرة فصول هي: الفصل الأول مادة 288 جريمة خطف طفل ذكر لم يبلغ سنة ستة عشر كاملة بالإكراه أو التحايل، الفصل الثاني مادة 289 جريمة خطف طفل أو أنثى لم يبلغ ستة عشر سنة كاملة من غير تحايل أو اكراه، الفصل الثالث مادة 290 جريمة خطف أنثى بالتحايل أو الإكراه واقتران الخطف بالمواقعه كرهاً عنها، الفصل الرابع الشروع في جرائم الخطف، الفصل الخامس م 292 جنحة عدم تسليم الصغير بناءاً على حكم القضاء لمن له الحق في حضانته وحفظه، الفصل السادس 293 جنحة عدم تنفيذ دفع مبالغ النقطة المحكومة بها، الفصل السابع م 280، 281، 283 جنحة القبض بدون وجه حق أو حسب شخص بدون أمر قضائي وذات العقوبة لمن أعار محل أو مكان لتنفيذ الحبس أو الحجز وتشديد العقوبة إلى جنائية إذا هدد هذا الشخص بالقتل أو عذب بالتعذيبات البدنية، الفصل الثامن جنحة خطف طفل حديث العهد بالولادة م 283، الفصل التاسع م 284 جنحة الامتناع عن تسليم طفل، الفصل العاشر م 285، 286، 287 جنحة تعريض الأطفال للخطر وظرفها المشدد.
