هذه الدراسةُ تَبرزُ أهميتُها النظرية كونها تَتَناولُ "عِلم القانون" La science juridique، وهذا يجعلُها تَنصبُ في إمطار الأبحاثِ العِلميةِ الجديدةِ التي تَرتكزُ على القانون كعلم قائم بحدِّ ذاتِه بغضِّ النَظرِ عن القواعدِ التقنيةِ المُثبتة له.
وقيمةَ الدراسةِ العَمليةِ لا تَقلُّ تأثيراً عن أهميِتها النظرية: فمسألةُ ترتيب الدفوع على أنواعِها مُرتبطةٌ أولاً إرتباطاً يومياً بعمل القاضي، وبمنهجيته في مُعالجةِ مَلفِ الدعوى المتكون أمامه، ومُتعلقة أيضاً بالدور المُعطى للفرقاء: فالردّ على إستحضار الدعوى يُلزمهم ترتيب النقاط المُدافع بها، وهذا الترتيبُ يَنعكسُ إنعكاساً بيِّناً على الفوزِ بالدعوى أو عَدَمِه.
والمشاكل التي يُثيرُها الموضوعُ شائكةٌ ومُتحركةٌ كونها تَطرحُ نِقاطاً دقيقةً للمعالجة...
وهذا ما يرمي الكُتيِّبُ إظهارَه وتَفنيدَ أواصرَ روافِده، وتِبيانَ نُصوصِ القَانونِ المُقارن...
مُحاولين ألاَّ نكون تَقليديين مُصوِّرين للنُظم والموادِ القانونيةِ كما هي، بَلْ عارضين بشكلٍ بُرهاني مُختلفِ الحُلولِ التي نَعتَمدُها".
