يعد موضوع حيثيات الأحكام المدنية وتسبيبها، من أدق المسائل القانونية وأكثرها تطبيقاً في الحياة العملية، لإرتباطها بمصالح الأفراد، فقد أصبحت هذه الحيثيات نظرية لا تنقطع المحاكم عن تطبيقها في كل ما يعرض عليها من دعاوى، وذلك لإتصالها بأصول التقاضي وحقوق ومراكز المتقاضين.
فضلاً عن ذلك أن حيثيات الأحكام المدنية، تتصل إتصالاً وثيقاً بقانون المرافعات المدنية، بوصفه الوسيلة المهمة التي تضمن الحق والعدل سواءً للقاضي أو المحامي والخصوم، ذلك أن وجود قواعد صالحة للتقاضي، يجعل تنفيذ القرارات القضائية أمراً طوعياً لدى الأفراد والقضاة، مما يؤدي إلى إشاعة الطمأنينة في نفوس أصحاب الحقوق، لذلك سماه المشرع المغربي بــ"قانون المسطرة المدنية" وكأنه بهذه التسمية، يدعو القضاة والخصوم بالسير بالإجراءات، كما يستخدم المهندس المسطرة على لوحاته، لكي تكون خطواته مستقيمة وكذلك ينبغي أن تكون إجراءات المحاكم دقيقة على المسطرة.
ومن هنا تأتي أهمية الموضوع الذي إختاره الأستاذ "شوان محي الدين" رئيس مجلس شورى إقليم كوردستان/ العراق، فهو دراسة تحليلية تطبيقية لأصول حيثيات الأحكام المدنية وتسبيبها، ومن أجل تغطية الموضوع من جوانبه المختلفة فإن هيكيلية البحث تتجسد بالخطة الآتية: المقدمة، فصل تمهيدي: تتميز العمل القضائي من غيره من أعمال السلطات الأخرى، الفصل الأول: ماهية الحكم القضائي، الفصل الثاني: تسبيب الأحكام المدنية وقواعده، الفصل الثالث: بطلان الأحكام القضائية وإنعدامها، الخاتمة: ذكر بإيجاز أبرز النتائج والإستنتاجات.
