Book Description
إن الإسلام عقيدة وأخلاق وأحكام شرعية، وتنقسم الأحكام الشرعية إلى قسمين: الأول: الأحكام الشرعية القطعية الثبوت والدلالة، الثاني: الأحكام الشرعية الظنية الثبوت أو الدلالة.
ويطلق على مجموع القسمين مصطلح (الفقه الإسلامي) الذي يعتبر المادة العملية في حياة الناس، إذ به تصحح العبادات، والمعاملات وسائر الأحوال التي يتعرض لها المسلم في حياته.
ولقد لقي الفقه الإسلامي في مسيرته التشريعية عناية فائقة من علماء هذا الدين الذين أفنوا حياتهم في بناء قواعده وأصوله وفروعه، فكتبوا المتون والشروح والحواشي.
تأتي أهمية الموضوع من خلال التعرف إلى حقيقة الوقف والغاية التي من أجلها شرع الله سبحانه وتعالى الوقف، وحث عليه النبي صلى الله عليه وسلم، فالله سبحانه وتعالى يقول: ﴿ لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ وَمَا تُنْفِقُوا مِنْ شَيْءٍ فَإِنَّ اللَّهَ بِهِ عَلِيمٌ ﴾... [آل عمران: 92].
فالآية تأمر بالإحسان، والوقف صورة من صوره الرئيسية، وما روي عن النبي صلى الله عليه وسلم أنه قال: "إِذَا مَاتَ الْإِنْسَانُ انْقَطَعَ عَنْهُ عَمَلُهُ إِلاَّ مِنْ ثَلاَثَةٍ: إِلاَّ مِنْ صَدَقَةٍ جَارِيَةٍ، أَوْ عِلْمٍ يُنْتَفَعُ بِهِ، أَوْ وَلَدٍ صَالحٍ يَدْعُو لَهُ".
