هذا الكتاب يتناول, "جريمة التهرب الجمركى" وهى من الجرائم الاقتصادية الهامة والتى زادرت فى السنوات الأخيرة وتلاحقت التشريعات بشأنها وصدرت الأحكام من المحاكم العليا وعلى رأسها المحكمة الدستورية العليا مما يجعلها خليفته بافراد هذه الدراسة لمعالجة آثارها وشرح أركانها وعقوبتها وغير ذلك مما يحتاجه الباحث فى علوم القانون أو المشتغل به.
وقد أتبعنا فى هذه الدراسة أسلوب شرح الجريمة من كافة نواحيها مع إيضاح آراء الفقهاء زالشرح والاشارة الى مبادىء محكمة النقض فى مواضعها, ولكن لما كان المبدأ الذى تقره محكمة النقض قد لا يغنى الباحث حتى لو كان مشروحاً ومعلقا عليه لأن أى مطلع على الحكم بكامله قد يتفهم المبادىء الواردة به طريقتة التى يختلف فيها مع غيره.
ولذلك فقد آثرت تخصيص جزء مستقل من الكتاب لإيرد كافة الاحكام التى أصدرتها دوائر محكمة النقض الجنائية والمدنية فى مجال هذا البحث وكذلك الأحاكم الدستورية الصادرة بشأن نصوص قانون الجمارك حتى تكون أسباب الحكم بكاملها تحت بصر الباحث مع تذييلها بتعليقاتنا اذا كان الأمر يحتاج إليها.
وقد جاء تقسيم موضوعات الكتاب كالتالى:
القسم الأول: جريمة التهرب الجمركى وينقسم إلى باب تمهيدى وثلاثة أبواب.
القسم الثانى: أحكام محكمتى النقض والدستورية العليا.
القسم الثالث: التشريعات الجمركية .
