أثار صدور القانون رقم 6 لسنة 1977 الخاص بإيجار الأماكن غير السكنية اهتمام الرأي العام بشكل لم يسبق له مثيل في تاريخ التشريعات بالأجال السكنية وغير السكنية علي حد سواء.
لقد جاء صدور هذا القانون لتلافي الوضع الجديد الناشئ عن صدور حكم الحكم الدستورية العليا بعدم دستورية الفقرة الثانية من المادة 29 من القانون رقم 49 لسنة 1977 في شأن تأجير وبيع الأماكن وتنظيم العلاقة بين المؤجر والمستأجر. والتي كانت تنص علي أنه "إذا كانت العين مؤجرة لمزاولة نشاط تجاري أو صناعي أو مهني حرفي فلاينتهي العقد بوفأة المستأجر أو تركه العين. ويستمر لصالح ورثته وشركائه استعمال العين بحسب الأحوال".
لذا، فقد كان من الضروري إصدار قانون جديد يحقق قدراً مقبولاً من التوازن في العلاقة بين المالك والمستأجر ويراعي البعد الإجتماعي، ويحقق المساواة بين الأنشطة المتنوعة ويعمل علي استقرارها، لذا فقد صدر القانون رقم 6 لسنة 1997 الفقرة الثانية من المادة 29 من القانون رقم 49 لسنة 1977 وبعض الأحكام الخاصة بإيجار الأماكن غير السكنية.
واحتار الكثيرون في فهم هذا القانون وحملت أجهزة الفاكس والبرق والبريد رسائل من داخل مصر وخارجها حاملة في صفحاتها حالات صارخة لملاك ومستأجرين علي حد سواء وكان لابد من عرض هذه الرسائل علي المستشارين القانونين المتخصصين في شئون الإيجارات وقد تعمدت عدم نشر أسماء أصحاب الرسائل التي تحوي جميعها بلا استثناء وقائع حية وحقيقية حفاظاً علي سمعة أصحابها واحتراماً لحق الخصوصية الذي يجب أن يتمتع به كل مواطن من عامة الشعب، كما أن تشر الأسماء لا يقدم معلومة أو خدمة أو فائدة للقارئ.
وهذا الكتاب- الذي بين يديك- يحوي جانباً من تساؤلات الرأي العام وردود المتخصصين عليها وهي ردود تعد بمثابة آراء استشارية وليست قواعد قانونية ملزمة لفرد أو لجهة من الجهات.
