يتمثل الكتاب في كون الجهة الإدارية وعند ممارستها لنشاط الضبط الإداري المتمثل في تنظيم النشاط الفردي لغرض المحافظة على النظام العام أو إعادته لنصابه عند اختلاله من خلال الوسائل والأساليب المقررة فانوناً لها فإن ذلك يقتضي منحها العديد من الإمتيازات اللازمة لتحقيق تلك الغاية وأن التمتع بتلك الإمتيازات لا يكون غاية بحد ذاتها بقدر ما هي وسيلة تمكن سلطة الضبط الإداري من أداء مهامها بفعالية ونجاح. وحيث أن لنشاط الضبط الإداري ارتباط مباشر بحقوق الأفراد وحرياتهم العامة لذا فإن ممارسة الجهة الإدارية لذلك النشاط لا يمكن أن يكون دون حدود أو قيود إذ أن عليها التقييد بإجراء الموازنة بين متطلبات المحافظة على النظام العام كونه غاية الضبط الإداري وبين احترام حقوق الأفراد وحرياتهم العامة حتى وأن تطلب ذلك تنظيماً لممارسة الأفراد لتلك الحقوق والحريات. عليه فإن على سلطة الضبط الإداري التقييد في الظروف العادية بحدود لا يمكن تجاوزها وتتمل بالحدود المتعلقة بالنظام العام باعتباره غاية الضبط الإداري والحدود المتعلقة بإجراءات الضبط الإداري بحيث يترتب على مخالفة تلك الحدود وعدم الإلتزام بها أن تكون تصرفات وإجراءات وقرارات سلطة الضبط الإداري غير مشروعة وعرضة للإلغاء من قبل القضاء الإداري.
ولغرض الحقوق على تلك الحدود وبيان تفاصيلها فإن ذلك كان السبب الدافع لنا في اختيار الموضوع. وقد آثرنا تناول الموضوع من خلال تقسيمه إلى فصل تمهيدي، وثلاثة فصول لاحقة، وعلى النحو الآتي:
الفصل التمهيدي: تأصيل فكرة الضبط الإداري.
الفصل الأول: الحدود المتعلقة بغاية الضبط الإداري.
الفصل الثاني: الحدود المتعلقة بالسبب في قرارات الضبط الإداري.
الفصل الثالث: الحدود المتعلقة بإجراءات الضبط الإداري.
