طبقت الإجارة المنتهية بالتمليك في بادئ الأمر تحت مظلة البنوك التقليدية، الأمر الذي جعلها وسيلة من وسائل الحصول على الربا، أو بتعبير أدق وسيلة من وسائل التمويل الربوي، إلا أن الصحوة الإسلامية التي شملت كل جوانب الحياة، أوجبت على المصارف توجيه أنشطتها واستثماراتها شيئًا فشيئًا نحو الشريعة الإسلامية، ونتيجة ذلك قامت المصارف الإسلامية بتوجيه أنشطتها إلى الصيغ الشرعية، وكان من بين تلك الصيغ التي استخدمتها المصارف "الإجارة المنتهية بالتمليك".
ولكن هذه المعاملة أثارت الجدل بين المختصين في الفقه الإسلامي نظرًا لتعدد صورها وتنوعها، واختلاف كل صورة عن الأخرى، خاصة وأن هذه الصور تحتوي على جملة إشكالات فقهية كل واحد منها يكفي للحكم بعدم شرعيته، لذلك كان البحث في هذه المعاملة بحثًا يتسم بالصعوبة نوعًا ما.
وقد نظمت الحديث في هذا الموضوع في مقدمة وثلاثة فصول وخاتمة: [المقدمة في أهمية الموضوع، الفصل الأول: مفهوم الإجارة المنتهية بالتمليك، الفصل الثاني: نشأة الإجارة المنتهية بالتمليك، الفصل الثالث: الحكم الشرعي في الإجارة المنتهية بالتمليك، الخاتمة في نتائج البحث].
