تعاقبت قوانين العمل منذ القانون رقم 91 لسنة 1959 ثم 137 لسنة 1981 ثم 12 لسنة 2003 ونظمت علاقة رب العمل بالعامل وكيفية تنظيم العمل والواجبات الملقاة علي عاتق العامل والمحظورات الملقاة على عاتقه وتأديبه والقواعد المنظمة لعمالة النساء والأطفال ووجوب مراعاة السلامة والصحة المهنية للمنشأة والرعاية الصحية والاجتماعية وأخيراً العقوبات الموقعة في حال مخالفة قواعد وأحكام قانون العمل.
ونظراً لاختلاف الظروف الاقتصادية والاجتماعية التي أدت لصدور قانون العمل المعمول به رقم 12 لسنة 2003 فقد رأينا أن نتبع منهجاً يتلخص في وجوب ذكر كل مادة من مواد القانون مع شرحها ثم التعرض للأحكام المتعلقة بها من أحكام محكمة دستورية أو إدارية عليا أو نقض وأحياناً التعرض للنصوص القانونية في القوانين الأخري التي تمس الموضوع سواء في القانون المدني أو قانون الطفل أو الشريعة الإسلامية.
وقد آثرت أن أدون معظم الأحكام التي جمعتها مع تبويبها كما وردت ولو تضمنت أو استندت إلي نصوص قوانين العمل السابقة والقانون الحالي بيد أنها كمبادئ تتعلق بالموضوع وذلك لندرة الأحكام الحديثة في هذا الموضوع.
وقد آثرت أيضاً رغم ذلك أن أورد الأحكام الصادرة في الموضوع حتي سنة 2006
كما أوردت آخر تعديلات قانون العمل وهو القانون رقم 90 لسنة 2005
ونأمل أن يكون هذا العمل عوناً لكافة القوانين والمشتغلين بهذا المجال.
