مختصر وكامل، كامل وواضح، واضح وعالم، عالم ومحسوس، هذه هي باختصار بعض الصفات التي يتحلى بها كتاب القاضي وسيم أبو سعد عن رقابة ديوان المحاسبة الإدارية المسبقة في لبنان. لقد جاء كتاب هذا القاضي المجتهد ليقدم للمكتبة القانونية اللبنانية والعربية، كما لكل باحث ودارس مرجعاً جديداً ومتميزاً عن أصول الرقابة التي يقوم بها ديوان المحاسبة اللبناني في كيفية وإجراءات صرف المال العام. إن الملفت للنظر هنا أن المؤلف قد استفاد إلى حد كبير من عمله كقاض في ديوان المحاسبة، مما أتاح له حرية المزج بين خبرته العملية في شؤون وشجون الإدارة وبين عمله النظري البحثي، وهذا ما أضاف نكهة جديدة لهذا الكتاب ميزته عن غيره من الكتب في هذا المجال. إضافة إلى ذلك، تنبع أهمية هذا الكتاب أيضاً بأن المؤلف لم يكتف بعرض لنصوص قانونية جامدة في مجال الرقابة المسبقة وعلى تحليلها، وإنما تعدى ذلك إلى المسائل التي تثار من جراء تطبيقها فاتحاً بذلك أبواب قانون المحاسبة العمومية على مصراعيه أمام م يشده حب الإطلاع والمعرفة.
كل ذلك بأسلوب علمي منهجي ملفت، وبلغة واضحة وبسيطة لا تستعصي على الفهم والإدراك.
وبالفعل، فبعد أن عرض المؤلف وفي قسم أول إلى النظام القانوني لرقابة ديوان المحاسبة الإدارية المسبقة شارحاً تكييفها القانوني، المعاملات الخاضعة لها، المعوقات التي تواجهها، وأخيراً النتائج المترتبة على مخالفة أحكام تطبيقها، نجده قد خصص القسم الثاني من هذا الكتاب لإثارة موضوع إلغاء الرقابة المسبقة. وهنا لم يتوان الباحث عن اقتراح ما يراه ملائماً للإصلاح والتجديد مستنداً بذلك على أنظمة أخرى مشابهة، وجاء جوابه الواضح والصريح دون لبس أو إبهام، الرقابة المسبقة هي الضمانة الأمثل لحماية المال العام في ضوء الواقع اللبناني الحالي من كل جوانبه: المالية، الاقتصادية، الإدارية والقانونية.
ومن هنا تأتي أهمية هذا الكتاب وضرورته لكل باحث، محام، قاض أو موظف، وكل المتعطشين للإلمام لمعرفة أصول المراقبة المالية التي يقوم بها ديوان المحاسبة على المال العام. إن العرض الوافي للنصوص الداعية لعمليات الرقابة، والشرح المسهب والمسند للأحكام القضائية وللآراء الاستشارية يجعل من هذا الكتاب في مصاف المراجع المهمة في هذا المجال.
