يشهد العالم ثورة تكنولوجية في مجال الأنظمة المعلوماتية جنى الإنسان ثمارها من خلال تسهيل سبُل الحياة في مختلف المجالات، وأصبحت من متطلبات العصر الراهن التعاطي مع هذه التكنولوجيا في القطاع الخاص في المؤسسات المالية البنوك والشركات، وفي القطاع العام الحكومي، فجميع النشاط العام في أغلب الدول في الوقت الحاضر يكون محوسباً، كما أنَّ العديد من الدول تعتمد نظام الحكومة الإلكترونية، وأصبحت هذه التكنولوجيا المعلوماتية وإستخدام الحواسيب والإنترنت جزءً من الحياة اليومية للأفراد، لا يستطيع الإستغناء عنها لتسيير نشاطه وتعامله مع القطاعيين العام والخاص، ونشاطه الإجتماعي والتواصل مع بقية أفراد المجتمع عبر وسائل التواصل الإجتماعي في العالم الإفتراضي.
وكما يسرت التكنولوجيا المعلوماتية سُبل الحياة، فإنَّها في المقابل يسَّرت سُبل إرتكاب الجريمة؛ فظهرت مصطلحات جديدة في العلوم الجنائية، كالجريمة الإلكترونية والمجرم الإلكتروني، والضحية الإلكترونية، والدَّليل الإلكتروني؛ فالأمر طبيعي أن يُستغل الجانب السلبي للتكنولوجيا المعلوماتية وإستخدامها كوسيلة لإرتكاب بعض الجرائم، أو أن تقع الجرائم على هذه التكنولوجيا، ويظهر نتيجة ذلك أنماط من الجرائم المستحدثة يصعب تكييفها وفقاً للنصوص العقابية التقليدية التي تقف في معظم الحالات عاجزة عن مواجهة هذه الإعتداءات، وقد أدرك العديد من المشرِّعيين ذلك؛ فسنُّوا تشريعات وبأساليب متنوِّعة تجرِّم صور الإعتداء على التكنولوجيا المعلوماتية وإستعمالها في إرتكاب الجرائم.
