يمكننا إيجاز جميع الإلتزامات التي يتحملها الفندقي في مواجهة النزيل في عبارة واحدة هي "توفير الإقامة الهادئة المطمئنة"، ولا يتحقق ذلك عملاً إلا إذا ضمن الفندقي سلامة النزيل وسلامة أمواله، وقدم له سائر الخدمات التي تجعل من إقامته في المنشأة ذكرى طيبة يود أن تتكرر، وفي ظل هذا المفهوم تنقسم دراستنا إلى ثلاثة أبواب نعرض في الباب الأول دراسة تفصيلية لعقد الإقامة الفندقية من حيث تعريفه وخصائصه وتكييفه وتمييزه عما قد يتشابه معه من العقود، ثم أركانه، وأخيراً سنعرض آثار العقد والمتمثلة في الإلتزامات التي يلقيها على عاتق أطرافه "الفندقي والنزيل"، أما في الباب الثاني سنعرض دراسة تحليلية موجزة لعقد الإدارة الفندقية نتناول فيها تعريفه وخصائصه وتكييفه وتمييزه عن غيره من العقود التي قد تتشابه معه، وأخيراً آثاره والمتمثلة في الإلتزامات التي يرتبها على عاتق أطرافه "المالك وشركة الإدارة الفندقية"، وأخيراً الباب الثالث ونتناول فيه بالدراسة والتحليل إلتزام الفندقي بضمان سلامة النزلاء، من حيث نشأة الإلتزام ومضمونه وأساسه القانوني، وأخيراً دعوى المسئولية عن الإخلال بهذا الإلتزام ووسائل دفع مسئولية الفندقي، ونختتم الرسالة بخاتمة موجزة تتضمن أهم النتائج المترتبة على البحث، مع بيان بعض الآراء والتوصيات التي نراها قد تكون صائبة ومفيدة.
