مؤلّف هذا الكتاب هو العميد ليون ديجي فقيه ومفكر فرنسي، ولد عام 1859، عمل أستاذاً للقانون الدستوري في جامعة بوردو عام 1892، ثم أصبح عميداً لكلية الحقوق فيها، تميّزت شخصيّة العميد ديجي بأنه لا يؤمن بما يسمى فلسفة ما وراء الطبيعة (الميتافيزيقا)، ولا يؤمن بالقانون الطبيعي، وينحاز فقط إلى الفلسفة الوضعيّة، التي انتقل منها إلى الوضعيّة القانونيّة.
وفكرة الوضعيّة القانونيّة هي الفكرة التي بنى عليها فلسفة هذا الكتاب، حيث تقوم الوضعيّة القانونيّة عنده على أساسين: الأول، إنكار فكرة الحق، فلا يوجد في النظام القانوني حقوق كحق الملكيّة، أو غير ذلك، ولكن توجد فقط قواعد القانون، والأساس الثاني، هو إنكار أن تكون إرادة الدولة هي مصدر القانون، فمصدر القانون هو التضامن الإجتماعي.
قام المؤلف في هذا الكتاب بإستعراض التصوّرات العامّة للقانون الخاص منذ مجموعة نابليون وقام بدراستها من الناحية العلميّة البحتة دراسة عميقة مستفيضة، حيث يضم الكتاب مجموعة المحاضرات التي دُعي العميد ديجي إلى إلقائها في صيف سنة 1911 بكليّة حقوق بيونس آيرس (الأرجنتين) حيث ضمّنها خلاصة أفكاره في القانون الخاص.
يُعد هذا الكتاب أحد أمهات الكتب القانونيّة في التاريخ، كما إنه مزود بدراسة معاصرة تحليليّة تزيد من اوجه الإستفادة المعاصرة من هذا المؤلف قام بها الأستاذ الدكتور سمير تناغو أستاذ القانون المدني بكلية الحقوق جامعة الأسكندرية، حيث قام بدراسة تحليليّة ونقديّة ذكر فيها أوجه الإتفاق والإختلاف مع المؤلّف، وأوجه الإستفادة، بتحليل عمق ودراسة دقيقة بخبرته الأكاديميّة والمهنيّة.
