إن هذا العلم دين، يجب أن نأخذه بقوة، وأن نأمر قومنا أن يأخذوا بأحسنه، فإنّ الذين يستمعون القول فيتبعون أحسنه أولئك الذين هداهم الله تعالى، وأولئك هم أولو الألباب، وإنّ الذين آمنوا ولم يلبسوا إيمانهم بظلم أولئك لهم الأمن وهم مهتدون، وإنّ الله تعالى قد أرسل رسله بالهدى ودين الحق، وأنزل معهم الكتاب والميزان ليقوم الناس بالقسط، وختمهم بسيدهم محمد صلوات ربي وسلامه عليه، وأنزل عليه القرآن الكريم هدى للناس، ومصدقاً لما بين يديه من الكتاب ومهيمناً عليه، ونسخ بشريعته الشرائع، فجاءت لإحقاق الحق وإقامة العدل والقسط، فحرمت الظلم وأكل أموال الناس بالباطل، وكان من قواعدها كل المسلم على المسلم حرام دمه وماله وعرضه، وأعطت كل ذي حق حقه وأمرت بنصب القضاة للفصل بين الناس في الخصومات وحذرتهم من الحيف والجور وحثتهم على الحكم بالعدل والقسط، وبينت وسائل إثبات الحق وطرق الحكم، وأرشدت الناس إلى كيفية حفظ الحقوق وصيانتها والوصول إليها عن طريق البينات، والتي منها الشهادة والإقرار واليمين والقرائن وقول أهل الخبرة والمعرفة، وهذا الأخير هو مجال هذه الدراسة وميدان بحثها، فجاءت تبين إعتبار قول أهل الخبرة وحجيته، وتبين أهميته وخطره ومجاله الواسع من حيث كونه وسيلة من وسائل إثبات الحقوق، وطريقاً من طرق بيان الحق وحكم الله تعالى في المسائل المتنوعة، والنوازل المستجدة المستحدثة، وهو موضوع مهم لا ينحصر في باب واحد من أبواب الفقه ولكنه ينتشر في معظم أبوابه فيدخل في العبادات والمعاملات والأحوال الشخصية والدعاوى والأقضية والبينات وغيرها، فاتسع مجال البحث مما رتب عبئاً كبيراً على الباحث، وكلف جهداً مضنياً في التنقيب عن الأحكام وتتبع المسائل.
