موضوع الحرية السياسية كما لاقى اهتمام الباحثين والفقهاء في مجال القانون الوضعي، فإنه يمثل اهتمام الباحثين والفقهاء المسلمين نظراً لارتباطه الوثيق بموضوع ممارسة السلطة، ومحاولة الاشتراك فيها من جانب الشعب، وفي ذلك يستوي الأمر بين النظم الديمقراطية والنظم السياسية الإسلامية ولذا فإن دراسة الحرية السياسية ستكون دراسة مقارنة بين الشريعة الإسلامية والقانون الوضعي وذلك من خلال التعرض لجوانبها المختلفة كحرية الفرد في الاختيار السياسي وحريته في الترشيح للمناصب التي نص المشرع على شغلها بالانتخاب، وكذلك حريته فى معرضة السلطة الحاكمة، وذلك في ثلاثة أبواب على النحو التالي: الباب الأول: حرية الاختيار السياسي بين الشريعة الإسلامية والنظم السياسية الوضعية، الباب الثاني: حرية الترشيح بين الشريعة الإسلامية والنظم الديمقراطية، الباب الثالث: حرية المعارضة السياسية بين الشريعة الإسلامية والنظم الديمقراطية.
