إن موضوع هذا الكتاب الذي قام بترجمته والتعليق عليه الدكتور معمّر خالد الشابندر، يتناول حالة من حالات انعدام المسؤولية الجنائية وهي حالة الجنون وحالة الإصابة بعاهة عقلية. ولهذا الكتاب أهمية إذ أن موضوعه يقع ضمن اختصاصات مترجمة وذلك بحكم اختصاصه في الأمراض العقلية والعصبية، وعمله كطبيب اختصاصي في محكمة الأحداث، فالمترجم بذلك يكون قد جمع بين علمي القانون والطب العقلي، يضاف إلى ذلك تمكنه من اللغتين العربية والإنكليزية، من هنا فإن هذه العوامل شكلت الأساس الذي انبنت عليه أهمية هذا الكتاب، ومن ثم نجاحه عند تقديمه لقراء العربية. والحقيقة أن الكتاب يعرض أهم نقطة من نقاط المسؤولية الجنائية، وهي مشكلة طال النقاش فيها ولم ينته منها إلى حلّ.
وتبدو أهمية الموضوع على وجه الخصوص إذا ما لوحظ أن أغلب التشريعات في العالم تفرّق بين الجنون وبين الإصابة بعاهة في العقل. هذا من ناحية فإن ذاك الموضوع قد تمّ عرضه بأسلوب شيق، حيث تمّ عرض أدق الأفكار العلمية في الطب العقلي وفي التشريع بوضوح يدلّ على قوة وممكن الكاتب، وذلك ضمن أسلوب قصصي مشوق آسر جعل من عرض الموضوع قصة مستكملة الحبكة الفنية.
والكتاب بعد ذلك سلسلة من الحلقات المتصلة في تطور العلاقة بين المبادئ القانونية وبين مبادئ الطب العقلي في مسألة المسؤولية الجنائية، كاملة كانت أم جزئية، خلال أكثر من قرن ونصف قرن من الزمان. وهو، إلى ذلك، بحث مقارن مستفيض الجوانب لأهم الخصائص التي تتميز بها مدرسة التشريع الأنكلوسكسوني، وهي واحدة من أمهات المدارس القانونية في العالم المتمدن، في أسلوب المرافعات الجنائية، وفي النظر إلى عدد كبير من الإشكالات الفقهية، وخاصة فيما يتعلق بقضايا المصابين بأمراض عقلية متنوعة، في حالة ارتكابها لجريمة القتل. هذا وإن الكتاب وبعد عملية الترجمة إلى العربية لم يفقد خصائصه تلك بل هو أضاف إليها ومن خلال أسلوب المترجم الأدبي المتميز ميزة أخرى لا تقل أهمية عن سابقاتها في طبيعته الإنكليزية.
