يثير موضوع الحرية الدينية العديد من التساؤلات الجديرة بالبحث، من ذلك: هل أن الشريعة الإسلامية مارست الإرهاب الديني تجاه الآخرين؟ أم أنها اعترفت لهم بالحرية الدينية؟ وهل جاءت الشريعة الإسلامية بأحكام تعالج هذه الحرية؟ فإذا كان الجواب بالإيجاب، فما طبيعة هذه المعالجة؟ ثم ما هو أثر الشريعة الغسلامية على دساتير الدول الإسلامية؟ وهل هنالك من تعارض بين اعتراف المواثيق الدولية بحق الأفراد بتغيير دينهم كيفما يشاؤن وبين النصوص الدستورية التي تقتضي بأن الإسلام هو الدين الرسمي للدولة؟ وهل أن لمثل هذه النصوص الدستورية قيمة قانونية ينبغي أعمالها في الواقع؟ أم أنها تتشح بوشاح أدبي لا غير؟ ثم ما هي طبيعة المشتجر الفقهي الدائر في العراق حول اعتبار الإعلام العالمي لحقوق الإنسان جزءاً من الدستور العراقي المنشود؟ وما أثر ذلك على الحرية الدينية؟ وما مدى استجابة الفكرة القانونية السائدة في العراق لمثل هذه النداءات؟، وعلى هذا تضمنت خطة البحث الفصول الأربعة الأتية:ـ الفصل الأول: التعريف بالحرية الدينية، الفصل الثاني: أساس الحرية الدينية، الفصل الثالث: قيود الحرية الدينية، الفصل الرابع: ضمانات الحرية الدينية.
