كتاب (تدويل الدساتير الوطنية) هو أفضل رسالة دكتوراة نوقشت في كليَة الحقوق – ستراسبورغ الفرنسية عام 1998 وأعدتها الدكتورة هيلين تورارHelene Tourard وطبعت من دار النشر الفرنسية LGDJ عام 2000 وقدمتها البرفسورة إليزابيت زولير Elisabeth Zoller.
بعد تعزيز مفهوم العولمة قانونياً على الصعيد الدولي جتء هذا الكتاب ليميز بصورة موضوعية بين التدويل والعولمة. حيث أوضح بأن تدويل الدساتير ناجم عن تصاعد تطور القانون الدولي والعلاقات الدولية وأثرها على السلطات العامة وتطبيق حقوق الإنسان والحريات الأساسية. إذ يشكل التدويل مسيرة مترابطة عبر سلسلة من تدابير السلطات العامة تتخذ إدارياً. بينما تنجم العولمة عن عوامل خارجة عن إرادة الدولة وتفرض عليها.
وتضمن الكتاب جزئين: الأول عالج التدويل والسلطات العامة ضمن ثلاثة أبواب تناولت أثر التدويل على السلطات التنفيذية والتشريعية والقضائية. وتقاسمها المسؤولية الناجمة عن تطور العلاقات الدولية، حيث حصلت السلطة التنفيذية على مكاسب جمى على حساب السلطة التشريعية.
وتناول الجزء الثاني عبر بابين موضوع أثر التدويل على حقوق الإنسان والحريات الأساسية مؤشراً على الركزالقانوني الدولي للفرد، ودور القضاء الوطني والدولي في تعزيز هذا المركز والمعوقات التي تحول دون تحققه.
وعالج الكتاب بصورة شاملة التطورات الدستورية والتشريعية في دول العالم المتعلقة بآليات إدراج المعاهدات الدولية في التشريعات الوطنية. وخاصة تلك المتعلقة بحققوق الإنسان. ودور القاضي الوطني في الإستناد إلى المعاهدات الدولية كونها مرجعاً لحسم المنازعات التي تطرح امام القضاء الوطني.
إن ترجمة هذا الكتاب، في ظل الأوضاع الدولية الراهنة، التي تتصاعد فيها أهمية المعاهدات والصكوك الدولية في المسيرة التشريعية والتنفيذية والقضائية للدولة. تساعد على تسليط الأضواء القانونية الدولية للحقوقيَين العرب من قضاة ومحامين ومشرَعين وأعضاء السلطة التنفيذية لمواكبة التطورات الدولية.
