إن امتناع الجهات الإدارية عن تنفيذ السندات التنفيذية الإدارية الصادرة ضدها، يرجع بصفة أساسية إلى عدم وجود قضاء إداري متخصص، أو وسائل لممارسته، ونتيجة لإحجام القضاء عن توجيه أوامر تنفيذية ضد الإدارة، لإفتقاده إلى وسائل تنفيذها، ولاسيما أن القوة التي يكفل بها احترام حجية الأحكام القضائية تحوزها الإدارة، وبالتلاي فلا تستخدمها ضد نفسها، وهو ما يعني عدم الخضوع لمبدأ سيادة القانون، أو مبدأ المشروعية لذلك أقر قانون المرافعات والتنفيذ المدني اليمني جواز التنفيذ ضد الإدارة، ونظم الوسائل الخاصة بتنفيذ الأحكام وما في حكمها الصادرة ضد الإدارة من خلال إجراءات استثنائية في المواد (487 إلى 490) وفيما عدا ذلك يطبق عليها القواعد العامة في التنفيذ الجبري بصفة عامة م(487/ أ) من القانون المذكور وفي إطار ذلك فإن الإجراءات الخاصة للتنفيذ الجبري ضد الإدارة هي محور دراستنا الحالية.
