باعتبار القانون ظاهرة اجتماعية يرتبط وجودها وتطورها بوجود وتطور المجتمع الذي تحكمه وتنظمه، فمن الطبيعي أن تتطور قواعد القانون الدولي العام لارتباطها بالمجتمع الدولي الذي عرف تطورات سريعة ومتلاحقة في السنوات الأخيرة، وقد كانت ملامح هذا التطور بصفة خاصة في امتداد قواعد القانون الدولي لتلج مجالات وموضوعات كانت في وقت قريب خاضعة للقانون الوطني أو الداخلي، فأدى هذا الامتداد إلى ظهور مواضيع أخرى ضمن القانون الدولي العام تتميز بنوع من الخصوصية والذاتية.
وقد عد نوع الحماية التي أضفاها هذا الموضوع الجديد تطوراً مهماً يضاف عن التطور الذي مسّ موضوع حقوق الإنسان وحرياته الأساسية ككل، من خلال احتواء الكثير من الاتفاقيات الدولية والإقليمية المعنية بمسائل حقوق الإنسان وحرياته الأساسية على كثير من الوسائل المنوط بها حماية حقوق الإنسان وحرياته الأساسية على المستوى الدولي وذلك بعد أن أصبحت موضوعات حقوق الإنسان وحرياته الأساسية من المسائل التي تهم المجتمع الدولي كله، إذ بعد أن كانت مسألة وطنية داخلية أصبحت مسألة دولية، حيث أصبح الموضوع محل اهتمام القانون الدولي العام سواء من حيث تحديد أنواع الحقوق والحريات، وكيفية التمتع بها وأيضاً حمايتها وقد تجاوزت مسألة حماية حقوق الإنسان وحرياته الأساسية حدود القوانين الوطنية لتصبح محل اهتمام المجتمع الدولي الذي اشتغل لأجل ضمان احترام هذه الحقوق والحريات داخل الدول المشكلة للمجتمع الدولي.
