Book Description
إن إنشاء وتشغيل وإدارة المرافق العامة التي تقدم الخدمة للجمهور، كان ولا يزال الشغل الشاغل للدولة القديمة والحديثة على حد سواء، ولم تتخل الدولة يوماً عن مسؤولياتها تجاه هذه المشاريع التي تمس البنية الأساسية والضرورية للدولة، إلا أنه وفي ظل العولمة وتحرير التجارة الدولية بين الدول وظهور نظام الخصخصة، فقد ازدادت الأعباء على الدولة مما أثقل كاهلها وأصبحت لا تستطيع تمويل كافة مشاريع البنية الأساسية وإدامة تشغليها بشكل يوفر الخدمات المطلوبة منها على الوجه الأكمل.
كما إن حاجة تلك المشاريع إلى التكنولوجيا والخبرات الكبيرة التي تفتقر لها الكثير من البلدان وخاصة النامية منها، أدى إلى إن تتجه الأفكار إلى ضرورة إيجاد آليات قانونية توفر لها إمكانية تشييد وتشغيل وإدارة ما تحتاجه من مشروعات ضرورية دون التأثير على ميزانياتها.
وفي ظل هذا الإتجاه برزت أساليب العقود الإدارية المستحدثة والتي من أشهر صورها ما يعرف بــ (B.OO.T) و (P.P. P) وهي مصطلحات دالة على الشراكة بين الإدارة والقطاع الخاص في إطار تعاقدي لتولى الثاني بمقتضاه إنشاء وإدارة وتشغيل المرافق العامة سيما مرافق البينية التحتية ثم إعادتها إلى الدولة بعد مدة يتفق عليها مسبقاً.
فقد وجدت الإدارة في الدول المختلفة في هذا النوع من العقود أفضل طريقة لتحقيق أغراضها، كونه يجنبها مغبة الإقتراض من العالم الخارجي ويحافظ على ما هو موجود لديها من أرصدة أجنبية، بالإضافة إلى تخفيف العبء عن كاهل الدولة وتسخير ما لديها من موارد لإنفاقها في أوجه أخرى.
ولأهمية هذا النوع من العقود في تطوير المرافق العامة الضرورية للدولة بوصفه من الخيارات الموجهة للدول النامية لحل مشكلة تشييد وإدارة البنية التحتية لما توفره من قدرات مالية ضخمة وتكنولوجيا عالية لا سيما تلك التي تحتكرها الشركات الأجنبية المتخصصة، الأمر الذي دفع غالبية بلدان العالم وخاصة النامية منها إلى تبني هذا النوع من أسالب التعاقد لتحريك عجلة التنمية الإقتصادية فيها.
