تحاول دراستنا هذه البحث في موضوع حماية مستخدمي شبكة الهواتف النقالة التي تعد من أهم المواضيع في تحقيق حياة إجتماعية متوازنة الحقوق، إذ إن مستخدم شبكة الهاتف النقال بحكم طبيعته الإجتماعية، لا يكف عن التعامل والتواصل مع غيره في كافة مناحي الحياة، وقد أفرزت الحاجة لهذا التواصل جملة من المشكلات القانونية تحتاج إلى البحث والدراسة.
ولعل من أبرز هذه المشكلات هي ضعف المقدرة الإقتصادية والفنية للمستخدم تجاه المحترف المتمثل بمقدم خدمة الإتصال صاحب هذه المقدرة وما ينتجه ذلك من عدم التوازن في عقد الإشتراك المبرم بينهما فضلاً عن المرحلة السابقة على التعاقد.
لذا تحاول دراستنا إعادة التوازن بين الطرفين والأخذ بيد المتعاقد الضعيف الذي غالباً ما يتعرض إلى التضليل والخداع في مرحلتي إبرام العقد وتنفيذه، وذلك من خلال إلزام مقدم الخدمة بجملة من الإلتزامات في مرحلتي تكوين العقد وتنفيذه والتي من شأنها أن تنير رضا المستخدم بالعقد المراد إبرامه من جهة وحسن إنتفاعه بخدمة الإتصال عند تنفيذ العقد من جهة أخرى.
كما تحاول دراستنا تبني نظام موحد من خلال إقامة مسؤولية مقدم الخدمة على عنصر الضرر دون إثبات الخطأ كون أن المستخدم هو صاحب المقدرة الإقتصادية الضعيفة في الحلقة التعاقدية، في الوقت الذي تكون فيه الحماية القانونية المدنية على المستوى المحلي قاصرة عن حمايته، وذلك من أجل أن تتساوى فيه مراكز المتضررين من حيث الحماية القانونية المدنية تجاه مقدم الخدمة سواء كانوا من المتعاقدين معه أو من الغير، بموجب هذا النظام الموحد يتمكن القضاء من حماية هؤلاء المتضررين بتعويضهم عن الأضرار المتوقعة وغير المتوقعة التي تلحق بهم من جراء إستخدام تلك الخدمة.
