إن الفقه الإسلامي بعد ما تربى في أحضان علم الحديث كتبت المؤلفات فيه وفرّعت المسائل إلى جانب العلوم الشرعية الأخرى، نهج الفقهاء الإعلام منهجاً جديداً، لما يستجد من مسائل ووقائع وتوسع في الدراسات الفقهية لبيان الرأي الفقهي، وإستنباطه، وبعد التوسع الكبير في طريقة العيش، وإستحداث كثير من المسائل التي تعترض حياة الإنسان بجوانبه كلها.
وهذه الرسالة هي دراسة في قاعدة من القواعد الفقهية المشهورة مع خلاف كونها اصولية أو كلامية وهي قاعدة (التسامح في أدلة السنن).
وهي مرجع للحكم في كثير من الأحكام الشرعية المستحبة، وقد أصبحت هذه القاعدة مورداً لإهتمام علمائنا لا سيما في العصر الأخير، إذ أولاها الشيخ الأنصاري عناية خاصة وتطرق إلى البحث عنها في رسائله، ودرسها المتأخرين، فمنهم من أفرد لها رسالة خاصة بها ومنهم من بحثها ضمناً لتنبهات البراءة.
وقاعدة التسامح في أدلة السنن، هي قاعدة إستخرجها وفقهاؤنا من نصوص مفادها أن من بلغه ثواب على عمل فعمل ذلك العمل برجاء تحصيل ذلك الثواب، فإنه يعطى ذلك الثواب وإن لم يكن ما بلغه صحيحاً، وإن لم يكن المعصوم قال ما بلغ هذا الشخص.
والنصوص في هذا المورد التي يفاد منها القاعدة عند فقهائنا، فيها ما هو صحيح سنداً، وعلى أساس هذه القاعدة افتى الفقهاء بإستحباب كثير من الأشياء مع عدم ورود نص خاص فيها، ومع عدم إنطباق عمومات أو مطلقات على تلك الأشياء.
